Terms of Use

The Analytics Liberty software package (hereinafter referred to as the “Software” or the “Solution”) is published by Coheris, a public limited company with a share capital of € 2,274,230, registered with the trade registry of Nanterre under number 399 467 927 and with registered office located 4 rue du Port aux vins, 92150 Suresnes (hereinafter “Coheris”).

The director of publication is Nathalie ROUVET LAZARE, CEO of Coheris.

The access, download, installation and use of the Software are subject to the legal provisions in force as well as to the present terms of use (hereinafter the “TOU”).

The User or Users is/are understood as any customer who has installed the Software.

By pressing “I agree“, Users acknowledges that they have read and adhered to and abide by all the terms of this contract without limitation or reservation.

Terms of Use (“TOU”) may be amended from time to time by Coheris.

1. CONTENT OF THE SOLUTION

The purpose of these TOU is to provide Users with a version of the Software for evaluation purposes only. As publisher and owner of the Software, Coheris reserves the right to make changes, corrections and / or improvements to information contained in the Software at any time and without notice.

Similarly, Coheris reserves the right to suspend, restrict or interrupt access to all or part of the Solution.

All the information made available to Users by Coheris is defined hereafter by the “Information”.

The information is updated regularly and the date of the last update is the one indicated on the home page.

In general, the Information provided by Coheris is provided for information purposes only and cannot, at any time, engage Coheris’ liability.

The Information shall be made available to Users, who may use it for their own evaluation or analysis purposes.

The free sharing use of the provided Software excludes any use for commercial purposes.

2. LIABILITY OF USERS

The use of the software is free.

Installation of the Software is the sole responsibility of Users. It requires reasonable performance IT equipment. Users shall have verified the compatibility of their hardware before installing the Software.

Users shall bear the costs of subscriptions and the costs of use, in particular as fixed by the Internet service providers.

Any Users who act in violation of these Terms of Use shall be liable to civil suits which punish in particular infringements of copyright, neighboring rights, rights of database producers and automated data processing systems and Provisions of the Criminal Code.

3. LIABILITY OF COHERIS

Coheris is not liable for any compatibility with User’s equipment.

Notwithstanding the provisions of Article 2 of the Terms of Use, in connection with the downloading and installation of the Software, Coheris guarantees the absence of any virus known to date in the Software, as well as normal operation of the Software in normal conditions of use.

Coheris’ liability cannot be sought for direct or indirect damages of any kind whatsoever resulting from the installation and / or use of the Software.

Within the framework of the present Terms of Use, Coheris does not ensure the maintenance of the Solution nor the assistance with its use.

It is specified that Coheris cannot be held liable if it is impossible for Users to use the Software, whatever the cause.

4. INTELLECTUAL PROPERTY

In accordance with the provisions of the Intellectual Property Code, it is reminded that Coheris holds all the intellectual property rights relating to the Software and the documentation which accompanies it as well as all their updates, improvements, former (old), current and future versions, and all the developments carried out by Coheris.

These rights are in no way transferred to Users under these TOU.

Users agree not to infringe in any way whatsoever the Coheris intellectual property rights on the Software.

It is expressly forbidden for Users to reproduce or represent elements, together or alone, making up the Software, for any purpose other than those defined in these TOU.

In addition, Users are expressly prohibited from modifying, improving, editing, translating, decompiling, disassembling or creating one or more works from the Software.

Users undertake not to infringe the intellectual property rights of Coheris or, where necessary, third parties through which Coheris has been duly authorized to exploit the rights relative to it.

Any reproduction, representation, exploitation of any kind whatsoever, all or part of the Software, without the prior written agreement of Coheris is unlawful and constitutes an act of infringement punishable by criminal penalties.

5. FINANCIAL CONDITIONS

License of use under the terms and conditions defined herein is granted to Users free of charge.

6. DURATION

These Terms of Use come into force upon the User’s download of the Software.

7. DATA

7.1 Personal Data Protection

Downloading and installing the Software requires the communication of personal data.

Users are informed, in accordance with article 27 Pursuant to French Law No. 78-17 of 6 January 1978 as amended relating to data processing and liberties that the information provided by them are necessary to answer their request. Information provided by users is intended to be used by the operator of the Website, responsible of processing, for administrative and commercial management purposes.

Users are also informed that they have a right to access, modify, rectify and delete any data concerning them. Users may oppose the processing of data that they have provided at any time, free of charge and without need for justification.

7.2 Data Security

The security and the backup of data provided in the Software by Users is the sole responsibility of Users.

It is the sole responsibility of Users to protect access to their terminal in order to prevent unauthorized third parties from having access to said data. Coheris cannot be held responsible for unauthorized third party access to the data entered on the Users’ terminal.

These Terms of Use are subject to French law.
